1. General Provisions
These Terms of Service (hereinafter — the "Agreement") govern the relationship between the operator of the Noders service (hereinafter — the "Operator") and an individual or legal entity (hereinafter — the "User") using the Noders service.
Noders is a visual node-based editor for AI generation of media content (images, video, audio). The service provides an interface for building generation pipelines using various AI models and providers.
The operator of the service is Individual Entrepreneur Gelvikh Leonid Vladimirovich, OGRNIP (Primary State Registration Number of an Individual Entrepreneur) 317774600202454, INN (Taxpayer Identification Number) 771004647806.
Registering with the service or beginning to use it constitutes the User's full and unconditional acceptance of this Agreement.
2. Terms and Definitions
- Service — the Noders web application, available at an address on the Internet, together with all of its functionality.
- User — an individual or legal entity registered with the Service and having accepted the terms of this Agreement.
- Tokens — the internal accounting unit used to charge for generation operations within the Service.
- Canvas — the User's workspace containing a visual scheme (graph) of nodes and the connections between them.
- Generation — the process of creating media content (images, video, audio or text) using AI models through the Service.
- Content — any results of Generation obtained by the User through the Service.
3. Registration and Account
3.1. Registration Requirements
- The User is obliged to provide accurate information when registering.
- Use of the Service is available to persons who have reached the age of 18. By registering, the User confirms that they have reached that age.
- Each User is entitled to create only one account. Creating multiple accounts may result in a block.
3.2. Account Security
The User bears full responsibility for keeping their credentials (password, access tokens) secure. The Operator bears no responsibility for the consequences of unauthorized access to the User's account that occurred through the fault of the User.
4. Tokens and Payment
4.1. Nature of Tokens
- Tokens are an internal accounting unit of the Service and are not a cryptocurrency, electronic money or any other payment instrument.
- Tokens are not subject to exchange for money, transfer to third parties or withdrawal from the Service.
- Tokens have no expiration date while the account remains active.
4.2. Topping Up the Balance
The User may acquire tokens by paying for one of the available top-up packages. Payment is processed through the YooKassa payment system (YooMoney JSC). Package prices are stated on the top-up page in Russian roubles. The Operator applies the simplified taxation system (STS); VAT is not charged.
The Operator does not collect or store Users' bank card data (card numbers, CVV, expiry date). All processing of payment data is carried out on the YooKassa side in accordance with PCI DSS requirements. The Operator stores only the payment identifier, amount, status and date of the transaction.
4.3. Deduction of Tokens
Tokens are deducted automatically when a Generation is started. The cost of each operation in tokens is determined by the AI model used and the generation parameters. Information about the cost is available to the User before the generation is started.
4.4. Refund of Tokens and Funds
- In the event of a technical error of the Service that led to an unsuccessful Generation, the deducted tokens are automatically returned to the User's balance.
- Tokens that have been purchased and used are not refundable in monetary form.
- In accordance with the Law of the Russian Federation "On Protection of Consumer Rights", a refund of funds is possible within 14 (fourteen) calendar days from the date of purchase, provided that the purchased tokens have not been used (in whole or in part). To request a refund, the User sends an application to support@noders.ru.
- The refund is made using the same method by which the payment was made, within no more than 10 (ten) business days from the moment the application is confirmed.
5. Rules of Use
When using the Service, the User is prohibited from:
- Generating content of a sexual nature (NSFW), including content involving minors.
- Creating content that exploits children in any form.
- Infringing the copyright and related rights of third parties when creating Content.
- Creating deepfakes depicting real persons without their written consent.
- Using the Service for sending spam, phishing or other fraudulent activities.
- Carrying out attacks on the Service's infrastructure, including DDoS attacks, attempts at unauthorized access, and circumvention of billing restrictions.
- Using the Service to generate content promoting violence, hatred, terrorism or extremism.
Violation of these rules may result in the account being blocked without a refund of the remaining tokens.
6. Intellectual Property
6.1. User Content
Content generated by the User with the help of the Service is the property of the User. The Operator makes no claim to rights in the generated Content and does not use it for commercial purposes without the User's consent.
6.2. Limitations
The User acknowledges that content created with the help of AI models may not be eligible for copyright protection under applicable law. The question of the protectability of AI-generated content is determined by the law applicable in the User's jurisdiction.
6.3. The Service
All rights to the software, design, trademarks and other elements of the Service belong to the Operator and are protected by intellectual property law.
7. Limitation of Liability
- The Service is provided on an "as is" basis. The Operator provides no warranties regarding uninterrupted operation of the Service, its fitness for the User's particular purposes or the absence of errors.
- The Operator bears no responsibility for the quality, accuracy or suitability of the results of AI generation.
- The Operator does not guarantee any particular level of availability (uptime) of the Service and bears no responsibility for temporary unavailability caused by maintenance work, provider failures or force majeure circumstances.
- The Operator bears no responsibility for loss of the User's data occurring for reasons beyond the Operator's control.
- The Operator's aggregate liability to the User is limited to the amount paid by the User over the last 3 (three) months of using the Service.
8. Bring Your Own API Keys (BYOK) and Their Security
The Service allows the User to use their own API keys from third-party providers (Bring Your Own Key, BYOK) to perform Generations.
8.1. Storage and Encryption
- The User's API keys are encrypted at rest in the database using the AES-256 algorithm (or an equivalent in terms of cryptographic strength). Keys are stored solely in encrypted form and are decrypted only in the server's memory at the moment a request is executed.
- Access to the encryption keys is restricted and controlled at the infrastructure level.
8.2. Use of Keys
- API keys are used solely to perform generations at the User's direct request — to send requests to the corresponding AI providers on behalf of the User.
- The Operator does not transfer the User's API keys to third parties, except for directly sending requests to the providers specified by the User.
- API keys are not used for any purposes other than those stated in this Agreement (performing Generations).
8.3. Deletion of Keys
- The User may delete their API keys from the Service at any time through the account settings. Deletion occurs immediately and irreversibly.
- When the User's account is deleted, all stored API keys are irreversibly deleted in cascade together with the rest of the account data.
8.4. User's Responsibility
- When using BYOK mode, the User bears full responsibility for the safekeeping, lawful use of, and expenses associated with their own API keys.
- The Operator bears no responsibility for the consequences of a compromise of the User's API keys that occurred through no fault of the Operator.
9. Amendment of Terms
The Operator has the right to make changes to this Agreement. In the event of material changes, the Operator notifies Users by email at least 14 (fourteen) calendar days before the changes take effect.
Continued use of the Service after the changes take effect signifies the User's consent to the new version of the Agreement. If the User disagrees, they have the right to stop using the Service and delete their account.
10. Applicable Law and Dispute Resolution
This Agreement is governed by and construed in accordance with the legislation of the Russian Federation.
In the event of a dispute, the Parties undertake to take measures to resolve it out of court by sending a written claim. The period for reviewing a claim is 30 (thirty) calendar days from the moment it is received.
If out-of-court settlement proves impossible, the dispute is referred to a court at the Operator's location in accordance with the applicable legislation of the Russian Federation.
